PURPOSE AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

Below you can find out for what purpose and on what legal basis Passibet may process your personal data, depending on the circumstances.

DATA OF THE USERS OF THE WEBSITE

Personal data of people using the www.quicksept.com website, that is: 

  • the IP address, 
  • user ID, 
  • information about devices and the browser from which access is made, 
  • information collected using cookies (in particular data and information about events such as e.g. visits product pages, clicks on the product, purchase of a product, adding to the cart, adding to the clipboard) 
  • orders saved in the system logs 

are processed:

  • To enable the Passibet to provide services electronically via the website www.quicksept.com including:
    • sharing content on the website, 
    • registering and maintaining a user account, 
    • placing orders, 
    • providing contact forms
    • handling complaints regarding these services as processing is necessary for the performance of the contract, the basis for processing is art. 6 sec. 1 letter b) of the GDPR;

  • in order to establish and pursue claims or defend against claims, defend Passibet’s position in criminal, administrative or misdemeanour proceedings, as well as counteract possible abuse or fraud – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is Art. 6 sec. 1 letter f) of the GDPR), but we explain that the legitimate interest of Passibet is to ensure the possibility of protecting the rights and interests of Passibet using the means provided for by law;

  • in order to ensure the security of the services provided by us electronically, including counteracting possible abuse or fraud, as well as ensuring the correct operation of the systems used to provide these services – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is art. . 6 sec. 1 letter f) GDPR), but our legitimate interest involves the need to ensure the security of the services we provide, including preventing fraud and abuse;

  • in order to carry out measurements, research and analyses, including statistical analyses, for the purposes of testing the effectiveness and improvement of our business – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is art. 6 section 1 lit. f) GDPR), but we explain that our legitimate interest includes the possibility of obtaining and analysing information in order to test the effectiveness and improve our business;

  • for the marketing purposes of Passibet, the legal basis for data processing for the above-mentioned needs, is our legitimate interest in the possibility of taking actions in the field of marketing of products offered by Passibet (Article 6 (1) (f) of the GDPR).

  • in order to fulfill our obligation to apply the so-called principle of accountability, i.e. the obligation for Passibet to demonstrate compliance with the provisions on the protection of personal data – as processing is necessary for performance of legal obligations incumbent on Passibet as the data controller, the legal basis for processing is art. 6 sec. 1 lit. c) GDPR.

The data is collected automatically upon entering the website www.quicksept.com  and is aimed at adjusting the technical parameters and content to the possibilities and requirements of your device or your preferences. Cookies are collected in accordance with the browser settings preferences of people using the www.quicksept.com  website. If you do not wish to install specific categories of cookies on your device, you should modify your browser settings accordingly. If the browser settings of the person using the www.quicksept.com  do not allow the installation of the categories of cookies necessary for the proper display of the website, the website may not work properly or not offer full functionality.

  • in order to fulfill orders placed by you for products included in the assortment of the online store www.quicksept.com – as data processing is necessary for the conclusion and then performance of the contract, the basis for processing is art. 6 sec. 1 letter b) of the GDPR;
  • in order to consider complaints submitted by you or a declaration of withdrawal from a distance contract – as data processing is necessary to fulfill the legal obligations incumbent on Passibet as the seller’s legal basis for processing is art. 6 section 1 lit. c) GDPR in connection with the provisions of the Civil Code on warranty or with regulations regarding consumer rights;
  • in order to process the return of goods purchased in the online store, to the extent that it is not a return made as a result of withdrawing from a distance contract, as data processing is necessary for the performance of the contract, the basis for processing is Art. 6 sec. 1 letter b) of the GDPR;
  • in order to handle other requests or inquiries that you can address to us in connection with an order in the online store – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is art. 6 section 1 lit. f) GDPR), but we explain that our legitimate interest includes the possibility of responding to the notifications sent to us;
  • in order to comply with the obligations imposed on us by law, including the Accounting Act or tax regulations (in the field of issuing and storing invoices and accounting documents) – as data processing is necessary to fulfill the legal obligations incumbent on Passibet as the seller the legal basis for processing is Art. 6 section 1 lit. c) GDPR;
  • in order to establish and pursue claims or defend against claims, defend Passibet’s position in criminal, administrative or misdemeanour proceedings, as well as counteract possible abuse or fraud – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is Art. 6 (1) (f) GDPR), but the legitimate interest of Passibet is to ensure the possibility of protecting the rights and interests of Passibet using the means provided for by law;
  • in order to fulfilll our obligation to apply the so-called principle of accountability, i.e. Passibet’s obligation to demonstrate compliance with the provisions on the protection of personal data – as processing is necessary to fulfilll the legal obligations incumbent on Passibet as the data controller, the legal basis for processing is art. 6 section 1 lit. c) GDPR.

The data required to place an order in the online store www.quicksept.com are marked as mandatory, and failure to provide them prevents placing an order. Providing other data is voluntary, and failure to do so does not affect the possibility of placing an order.

DATA OF PERSONS WHO REGISTER (SET UP AN ACCOUNT) IN THE ONLINE STORE

Personal data that you provide us with by creating an account in the online store www.quicksept.com  and using this account, i.e.

  • in order to establish, shape the content, change, terminate and correctly implement the services provided by Passibet electronically to registered users of the website www.quicksept.com and complaints regarding these services – as data processing is necessary for the performance of the contract, the basis for processing is Art. 6 (1) (b) of the GDPR;
  • in order to consider complaints submitted by you or a declaration of withdrawal from a distance contract – as data processing is necessary to fulfilll the legal obligations incumbent on Passibet as an electronic service provider, the legal basis for processing is art. 6 section 1 lit. c) GDPR in connection with the regulations on consumer rights;

For purposes related to orders placed via your account for products in the assortment of the www.quicksept.com online store, the data required to set up and maintain an account in the www.quicksept.com online store are marked as mandatory, and failure to provide them makes it impossible to create an account. Providing other data is voluntary, and failure to do so does not affect the possibility of creating and maintaining an account. 

Deleting the data required to maintain an account in the www.quicksept.com online store automatically deletes the account.

DATA OF PERSONS CONTACTING PASSIBET

By contacting us, you can provide us with your personal data, such as 

  • name and surname, 
  • telephone number, 
  • e-mail address, 
  • Home / office address 
  • and other data provided by you during the contact, and in the case of telephone contact, also a recording of your voice.

The data obtained during contact with you are processed:

  • in order to correspond with senders of messages and to handle requests addressed to Passibet, not related to your contract with Passibet, as the processing is necessary for the purposes of the legitimate interest, the legal basis for processing is art. 6 (1) (f) GDPR), but the legitimate interest of Passibet includes the ability to respond to communication addressed to Passibet;
  • in order to undertake steps at your request to conclude a contract between you and Passibet or to perform a contract between you and Passibet, if in communication you express your desire to conclude a contract with Passibet or your communication relates to such a contract – as data processing is necessary to conclude a contract, you want to be a party or the performance of the contract, the basis for processing is Art. 6 (1) (b) of the GDPR;
  • in order to provide you with commercial information from Passibet, if you expressly request such information by communicating with Passibet – as processing is necessary to take, at your request, actions prior to entering into a contract, the legal basis for processing is art. 6 sec. 1 lit. b) GDPR.
  • in order to take steps to conclude a contract between Passibet and the entity on behalf of which you are acting, maintain ongoing business contacts with such entity, as well as to perform contracts concluded with it, when you contact Passibet on someone else’s behalf – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is art. 6 sec. 1 letter f) of the GDPR), but the legitimate interest of Passibet includes the possibility of negotiating and performing contracts and maintaining business contacts with persons acting on behalf of other entrepreneurs;
  • in order to monitor the quality of services provided by Passibet – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is art. 6 sec. 1 letter f) GDPR), whereby we explain that the legitimate interest of Passibet includes the possibility of obtaining information by us in order to improve the quality of our services, in particular the quality of customer service;
  • in order to measure, research and analyze the reports received, including statistical analyzes, for the purposes of testing the effectiveness and improvement of our business – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is Art. 6 (1) (f) of the GDPR),  our legitimate interest includes the possibility of obtaining and analyzing information in order to test the effectiveness and improve our business;
  • in order to fulfilll the legal obligation incumbent on Passibet, if the communication relates to such an obligation of Passibet (e.g. in the case of complaints or notifications regarding personal data) – as data processing is necessary to perform the obligations legal basis for the processing of Passibet is Art. 6 section 1 lit. c) GDPR;
  • in order to ensure the security of the services we provide, including counteracting possible abuse or fraud, or risk management – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is art. 6 sec. 1 lit. f) GDPR), our legitimate interest includes the need to ensure the security of our services, including counteracting fraud and abuse, as well as managing the risk of our business;
  • in order to establish and pursue claims or defend against claims, defend Passibet’s position in criminal, administrative or misdemeanour proceedings, as well as counteract possible abuse or fraud – as processing is necessary for the purposes of the legitimate interest of Passibet, the legal basis for processing is Art. 6 (1) (f) GDPR), the legitimate interest of Passibet is to ensure the possibility of protecting the rights and interests of Passibet using the means provided for by law
  • in order to fulfilll our obligation to apply the so-called principle of accountability, i.e. Passibet’s obligation to demonstrate compliance with the provisions on the protection of personal data – as processing is necessary to fulfilll the legal obligations incumbent on Passibet as the data controller, the legal basis for processing is art. 6 section 1 lit. c) GDPR.

 

Respecting the privacy of you and other people to whom you can refer when communicating with us, please provide us with only the data necessary to handle the case with which you are addressing us. If you intend to provide us with someone else’s personal data, please make sure in advance whether there is a legal basis for the processing of this data by Passibet (e.g. such basis may be the consent of the data subject to provide this data to Passibet in order to handle the matter with which we are contacted) and whether the data subject is aware of the rules of personal data processing by Passibet set out in this policy.

Depending on the method of communication, providing contact details in the form of a correspondence address, e-mail address or telephone number is necessary to receive a Passibet response, and failure to provide them prevents such response, providing other data is voluntary, although depending on the type of case you are dealing  with, failure to provide further information may cause the further service impossible or extend the process. 

PERSONAL DATA RECIPIENTS

We will transfer personal data to entities that act on our behalf, to the extent that it is justified by the purpose of processing, it may include providers of IT services and solutions, marketing agencies, entities providing accounting, legal, financial, insurance and administrative services, auditors, entities conducting our commissioned customer satisfaction survey, entities dealing with mass mailing of messages, advisors. Each transfer of the data referred to in this paragraph will take place on the basis of an appropriate personal data entrustment agreement.

If required by law or necessary to pursue or defend against claims, we will also transfer personal data to public authorities, including courts, prosecutor’s office or the police, and professional representatives (these entities will then become separate data controllers).

If you decide to make a payment through one of the entities that cooperate with electronic payments, we will provide your data including the name, number and value of the order, IP number, email address, telephone number, your customer ID assigned to you by the entity servicing payments to this entity. In order to process your payment. This entity will become a separate administrator of your data.

If you decide to order products from the www.quicksept.com with delivery to the indicated address or to a parcel locker, or in a situation where Passibet will send you a traditional parcel (e.g. a letter with a reply to your application), your data, in to the extent necessary to deliver the parcel, will be forwarded to Poczta Polska, a courier company or a company servicing Paczkomaty, those entities will become separate administrators of these data. 

PERIOD OF PROCESSING OF YOUR PERSONAL DATA

  • To the extent that your personal data is processed by us for the performance of the contract, we will process it for the duration of the contract.
  • To the extent that personal data is processed for the implementation of our legitimate interests, we will process them for the duration of the legitimate interest, unless you object to the processing of this data in advance. If we are able to demonstrate the existence of valid, legally justified grounds for further processing of this data, overriding your rights or necessary to establish, assert or defend claims, defend Passibet’s position in criminal, administrative or misdemeanour proceedings, as well as counteracting possible abuse or frauds, we will process them despite your objection.
  • To the extent that personal data are processed on the basis of the consent of the data subject or – in the case of data of children – on the basis of the consent of the statutory representative of the data subject, they will be processed until the consent is withdrawn, and in the case of given children, no longer than until a child of 13 years old.

  • To the extent that personal data is processed for the purposes of fulfilling our obligations under the law (e.g. from the Accounting Act, tax regulations or GDPR), we will process them for the period resulting from such provisions (e.g. for billing purposes) Your data will be stored for 5 years from the end of the calendar year in which the payment deadline for the tax related to the order or transaction expired).
  • To the extent that personal data is processed for the purpose of establishing or pursuing claims, as well as to defend against such claims, we will process them for the period of limitation of your or our claims.

YOUR  PERSONAL DATA PROCESSING RIGHTS

When it comes to the processing of your personal data by Passibet, you have the following rights:

The right to information, access and copy of data: 

The right to obtain confirmation whether we process your personal data, the right to access this data, the right to obtain information about the processing of personal data, including, in particular, information about the purposes of personal data processing, data categories, entities to whom the data is disclosed, the period of data storage, information about your rights related to the processing of your data by us and about a complaint to the supervisory body, about data sources (when the data is not collected directly from you), as well as the right to obtain a copy of your personal data.

The right to rectify or supplement: 

The right to request the rectification (correction) of incorrect or incomplete personal data;

Right to restriction of processing: 

The right to request restriction of processing of your personal data in the cases specified in art. 18 GDPR, when you question the correctness of your personal data processed by us, the processing of your personal data is unlawful, but you oppose the deletion of this data and instead request the restriction of its use, we no longer need your personal data to achieve our goals, but you need them to establish, investigate or defend claims or if you have objected to our processing of your personal data due to your special situation \ If the processing of your personal data is restricted, we will be able to store it and use it only to establish, assert or defend claims, to protect the rights of another natural or legal person, or for important reasons of public interest of the European Union or a Member State, and we will be able to take other actions only with your consent;

The right to delete: 

The right to request the deletion of your personal data: You have the right to request that Passibet delete your data. Passibet must comply with your request if your personal data is no longer necessary to achieve the purposes for which it was collected and processed, if you withdraw your consent to their processing, and there is no other basis for us to process this data, if you object to us processing your personal data due to your special situation, and we do not have grounds for processing that would override the grounds for your objection, you will object to processing for marketing purposes, we have processed your personal data unlawfully, deletion of your data  is necessary to comply with a legal obligation provided for in EU or Polish law, the personal data has been collected in relation to offering information society services ;.

The right to transfer data: 

If your data is processed automatically on the basis of consent or contract, you have the right to receive data that you provided to us on the basis of consent or contract, in a structured, publicly available format suitable for machine reading (e.g. computer), and you can ask us to send your data to another administrator, provided that it is technically possible to Passibet and another administrator;

Opposition to direct marketing: 

You with the right to object at any time to the processing of your personal data by us for the purposes of direct marketing, without the need to justify it;

Objection due to your special situation: 

to the extent that the basis for the processing of your data is our legitimate interest, you have the right to object at any time to the processing of this data for reasons related to your particular situation, at the same time providing an explanation  of the special situation which, in your opinion, justifies the cessation of our processing of your data.

Withdrawal of consent to data processing:

 To the extent that your data will be processed on the basis of your consent, you have the right to withdraw it at any time, and the withdrawal of consent does not affect the processing activities performed by us based on consent before its withdrawal

Withdrawal of consent to marketing communication: 

You can withdraw consent to marketing communication at any time;

To exercise your rights, please contact us using the contact details provided in point I. Information on how to opt out of receiving commercial information may be indicated in the footer of commercial information in the form of an e-mail.

Complaint to the supervisory authority: 

You also have the right to place a complaint with the data protection authority competent for your place of habitual residence, place of work or place of the alleged infringement (in Poland, this authority is the President of the Personal Data Protection Office) if you decide that the processing your personal data by us violates the law on the protection of personal data, including the GDPR.

CONSEQUENCES OF NOT PROVIDING PERSONAL DATA

Providing personal data is voluntary, however, failure to provide some personal data (identity or address data) may prevent us from providing you with services like making purchases in the online store www.quicksept.com , answering correspondence and handling matters with which you contact us or fulfilling our legal obligation.

For this reason, providing basic data (user identity, e-mail address, telephone number, and when placing an order – also postal addresses) is necessary to make a purchase in the online store.

Failure to provide the required data in order to receive commercial information will prevent their transmission.

Failure to provide the data required at the stage of registering the user account of the online store will prevent the registration of the user account.

Each time the data necessary to perform the contract, respond to the notification or fulfill our legal obligation are marked as “mandatory”, and failure to provide them will prevent the performance of the contract, reply or fulfillment of the legal obligation. Providing data that is not marked as “mandatory” is voluntary, and failure to do so does not have any negative consequences.

 

VII. SAFETY RULES

For your safety, remember to:

  • Create a login and password to your Customer account that it impossible to be easily guessed by third parties. In particular, we recommend using a combination  of characters and numbers, upper and lower case letters and special characters in the password;
  • keep the login and password for the Customer’s account secret, in particular not transferring data (login, password) to any third parties;
  • use up-to-date antivirus programs, and regular scanning of disks for viruses and spyware;
  • use only up-to-date versions of web browsers and updating the operating system of your computer or mobile device;
  • use the website and online store only through trusted devices (such as computers and tablets) on which only legal software has been installed. Using someone else’s end devices as well as untrusted ICT networks creates the risk of third parties intercepting your login, password or other data you provide;
  • immediately change your password if you suspect that it may no longet by confidential;
  • report to kontakt@quicksept.com any issues or unusual situations that may threaten the security of information when using the www.quicksept.com website

The website www.quicksept.com uses so-called cookies. Cookies are small files (in particular text files) that the website you visit saves on your end device (computer, smartphone, tablet, etc.) from which you connect to the website. The information contained in cookies consists of a series of letters and numbers. Cookies can store personal data. By saving these files on your device, it is possible, among others to 

remember login details, so you do not have to enter your login and password each time, 

remember the goods you added to the basket, or adjusting the content of the website to your interests. 

Thanks to cookies, it is possible to collect statistical data, which allows us to develop our offer in accordance with the preferences of our customers. 

Cookies are in no way harmful to your device and do not change its settings or the settings of the software installed on it. The content of these files can only be read by the ISP that created them.
